The Discover® Everyday Giveaway Promotion began on 1/1/11 and continues through 12/31/11, and is comprised of three (3) separate sweepstakes with the following entry periods: January-April 2011, May-December 2011, and September-December 2011 (each a "Sweepstakes", collectively the "Promotion"). The Promotion is sponsored by DFS Services LLC, 2500 Lake Cook Rd. Riverwoods, IL 60015 (the "Sponsor"). As used in these Official Rules, "Card" means a credit or debit product that displays the Discover Network acceptance mark and is issued by Discover Bank or any other participating Card issuers. Promotion open only to legal residents of the 50 U.S., D.C. and Puerto Rico who are 18 years of age or older as of time of entry. Employees of DFS Services LLC (Sponsor) and participating Card issuers are not eligible to win any prize; their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and/or those living in the same household of each, whether or not related to, are not eligible to win a monthly or the Grand Prize. Employees of affiliates, subsidiaries, parent companies, and advertising and promotion agencies of DFS Services LLC or participating Card issuers are not eligible to win the monthly or the Grand Prize. These Official Rules govern the September-December 2011 Sweepstakes:
Beginning 9/1/11 through 12/31/11 ("Sweepstakes Period"), you will automatically receive one entry into a daily random drawing, a monthly random drawing and into the Grand Prize random drawing each time you use your Card to make a purchase or take a cash advance or disbursement at an ATM, financial institution, casino or online (each considered a "Transaction"). Transactions must post to your account during the Sweepstakes Period and within 3 days of the date of the Transaction. Sponsor is not responsible for any merchant delays in processing Transactions. The following do not qualify for entry: i) balance transfers; ii) cash advances or disbursements made using checks iii) the purchase of optional products offered by Card issuers including, but not limited to, identity theft protection, wallet protection, credit life insurance and payment protection; iv) transactions made with lost or stolen cards or stolen card numbers; v) transactions made with prepaid cards, stored value cards or gift cards; vi) transactions made with debit cards requiring a PIN which are not processed on the Discover or PULSE Networks.
During the Sweepstakes Period, there will be specific timeframes that highlight a Featured Category. During those timeframes, when you make an eligible Transaction in a Featured Category, you will receive additional entries for each Transaction. * Automotive purchases are those made at merchants classified as car and truck retailers, auto supply stores, auto repair/paint shops, and car wash/towing services.
** Eligible purchases must be made at stand-alone IZOD, Bass, and Van Heusen retail locations only. To find a location nearest you, visit www.PVH.com.
***Clothing and Department stores are defined as retailers selling a wide variety of merchandise, with separate checkout counters in each department. Clothing stores are defined as stand-alone men's, women's and children’s clothing retailers. Purchases made at warehouse clubs or discount stores (as defined by Sponsor) are not eligible.
****Travel and Gas purchases are those made at merchants classified as airlines, cruise lines, transportation service providers (railways, buses, taxi cabs, car/truck rental), hotels and tour operators/travel agencies. Gas purchases are those made at merchants classified as stand-alone gas stations.
If a purchase is coded for a category other than those listed above, it will not qualify. Eligibility classification of a Featured Category is at Sponsor's sole discretion.
To enter a daily drawing and a monthly drawing and to be entered into the Grand Prize drawing without using a Card, print your full name, address (no post office box addresses accepted), city, state, zip code and date of birth (mm/dd/yyyy) on a plain piece of 3" x 5" paper and mail in a stamped hand-addressed business-size envelope to: Discover Everyday Giveaway Sweepstakes, P.O. Box 5610, Blair, NE 68009-5610. IMPORTANT: You must indicate on the lower front left side of your mailing envelope the date of the daily random drawing (from 9/1/11 through 12/31/11) you wish to enter. Limit one date per entry and one entry per outer mailing envelope. If you wish to receive additional Entries (See Rule #3), the date you list must be a date within a Timeframe shown and you must also print the corresponding Featured Category (for example: September 10th - Automotive). For each such eligible entry received, you will receive Bonus Entries as specified. All eligible entries received will be entered into the daily drawing specified and the monthly drawing for that month. In addition, all eligible mailed entries received will be included in the Grand Prize random drawing. No mechanically reproduced entries permitted. Illegible entries are void. Released Parties (as defined below) are not responsible for lost, late, mutilated, delayed, inaccurate, incomplete, postage due, misdirected entries or entries not received in time for the entrant-specified random drawing. To be eligible for a daily drawing and the applicable monthly drawing, your entry must be received no later than 5 business days after the date you have indicated on your entry envelope. Entries received more than 5 days after the date printed by entrant on the envelope will be disqualified for both the daily and the monthly drawings but will be included in the Grand Prize drawing. Your entry must be received by 1/10/12 to be included in the Grand Prize drawing.
Separate daily and monthly random drawings will be conducted within approximately 10 business days following each day and month of the Sweepstakes from among all eligible entries received for each specific day's or month's drawing. Eligible entries will be included in the drawing for the date and month your qualifying Transaction is posted to your account (per Rule #2) or the date and month you indicated on your mailing envelope (per Rule #4). The Grand Prize random drawing will be conducted on/about 1/17/12 from among all eligible entries received throughout the Promotion. Drawings will be conducted by D.L. Blair, Inc., an independent judging organization whose decisions are final on all matters relating to this Sweepstakes and the Promotion. Odds of winning a daily or monthly prize will depend upon the number of eligible entries received for that daily or monthly drawing. Odds of winning the Grand Prize will depend upon the total number of eligible entries received throughout the entire Promotion. Winners will be notified by mail.
(1) Grand Prize - $1,000,000 (to be awarded as a check);
(4) Monthly prizes (one per month for the September - December 2011 Sweepstakes Period) - $25,000 awarded to winner and $25,000 donated by DFS Services LLC to a public school (including charter schools) of winner's choice (to be awarded as a check). Selected schools must enroll students in grades within K-12. In the event the winner does not wish to designate a public school to receive a check, the winner can select a local chapter of one of the following organizations that support public education: Junior Achievement; Boys and Girls Clubs of America; Big Brothers Big Sisters. Limit one monthly prize per person throughout the Promotion;
(18,300) Daily Prizes (150 prizes per day) - A $25 Discover Gift Card. Discover Gift Card terms and conditions apply for all gift card prizes. Sponsor reserves the right to issue checks in lieu of gift cards to winners in any state in Sponsor's sole discretion.
To be eligible to receive a prize, a potential winner's Card account must be in good standing at time of winner selection. In the event that there is more than one authorized person on a Card account, the primary Card account holder will be deemed the winner. Prize consists of only the item specifically listed as the prize.
Potential Grand Prize winner and monthly prize winners will be sent an Affidavit of Eligibility/Release of Liability/Publicity Release/Prize Acceptance Form which must be completed and returned within seven (7) business days of attempted notification. Noncompliance within this time period or return of any prize/prize notification as undeliverable will result in disqualification without further notice and an alternate winner will be selected. Daily winners winning multiple prizes with an aggregate value of $600 or more during 2011 will be required to execute a W9 form and their total winnings will be reported to the IRS, as is required by law. Sponsor may conduct a background check on the potential Grand Prize winner and monthly winners. Such background check may include (but is not limited to) investigation of employment history, criminal or other arrest or conviction record, and any other factor deemed relevant by Sponsor to help ensure that his/her participation in the Sweepstakes will not, in Sponsor's sole discretion, bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on Sponsor. All federal, state and local income taxes are the sole responsibility of winner. All applicable federal, state and local laws and regulations apply. Winners may make no substitution or transfer of prize. Entrants (or parent/legal guardian if entrant is deemed a minor in his/her state of residence) agree to hold DFS Services LLC, participating Card issuers and their respective affiliates, subsidiaries, and parent companies, and advertising and promotion agencies and the respective directors, officers, employees, and assigns of each (collectively, "Released Parties"), harmless against any claims, damages or liability due to any injuries, damages or losses to any person arising out of use of prize or participation in any Sweepstakes-related activity. Acceptance of a prize constitutes permission to the Sponsor, the participating Card issuers and their agencies to use, in their sole discretion, each winner's name and state of residence and/or likeness for purposes of advertising/trade in any and all media now or hereafter known worldwide in perpetuity without further compensation, unless prohibited by law. All materials submitted become sole property of Sponsor and will not be returned. Released Parties are not responsible for computer, network, technical, printing, typographical, human or other errors, problems or malfunctions relating to or in connection with the Sweepstakes, including without limitation, errors, problems or malfunctions which may occur in connection with the administration of the Sweepstakes, the announcement of the prizes, the processing of entries or in any Sweepstakes-related materials; or for Transactions that are lost, misdirected, or fail to enter into the processing system for any reason; or are processed, reported, or transmitted late or incorrectly; or are lost for any reason, including computer, telephonic, paper-transfer, or human error, or electronic, computer, or telephonic malfunction, damage, error, omission, interruption, defect, delay in operation or transmission, or any combination thereof. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and judges, which are final and binding. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control. In the event that the Sweepstakes scheduled to run September-December 2011 does not occur, a notice will be posted online at this website and the drawing for the Grand Prize will be conducted from among all eligible entries received during the previously completed Sweepstakes only. Sponsor may prohibit a participant from participating or winning a prize (and void all associated entries) if, in its sole discretion, it determines that said participant is attempting to undermine the legitimate operation of the Promotion by cheating, deception or other unfair playing practices or intending to annoy, abuse, threaten or harass any other participants or Sponsor's representatives. If for any reason this Sweepstakes is not capable of running as planned, including, but not limited to, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right in its sole discretion to cancel the Sweepstakes. If terminated, Sponsor may, at its discretion, award the prize for the drawing at issue from among all non-suspect, eligible entries received for such drawing up to time of such action. In no event will more than the stated number of prizes be awarded.
Names of the daily and monthly winners will be posted periodically at this website throughout the Promotion. The name of the $1,000,000 Grand Prize winner will be posted from 2/14/12-2/27/12.
ONLINE NOTICE: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to cancel or modify the Promotion if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by Sponsor/administrator, in their sole discretion. Any damage made to the website will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
